Read Before Purchasing. These disclosures are required by Texas professional rules. By using MaxWills, you acknowledge each of the following.

1. Not a Law Firm — No Legal Advice (TDRPC 5.05)

MaxWills is a document preparation service operated by Max AI, Inc. MaxWills is NOT a law firm and does NOT provide legal advice. Consistent with Texas Disciplinary Rule of Professional Conduct 5.05 (Unauthorized Practice of Law), MaxWills provides legal information — general statements of Texas law — and not advice tailored to your individual facts. Nothing on this website or in any document it produces constitutes legal advice.

2. No Attorney-Client Relationship

Your use of MaxWills does not create an attorney-client relationship. No attorney-client privilege applies to your communications with MaxWills. Stephen T. Bowling, J.D., is a licensed Texas attorney and founder of Max AI, Inc.; he acts in a supervisory capacity over document quality — not as your attorney unless you separately retain him or Texas Defense Team.

3. Attorney Review Scope

When you purchase an Attorney Reviewed package, a licensed Texas attorney reviews your draft documents. This review is limited to the documents produced from your interview answers and does not constitute general estate planning advice or full representation. The attorney review fee is a legal services fee processed through IOLTA trust account per TDRPC 1.04 and 1.14.

4. Texas Will Execution — Electronic Signatures Not Valid

Critical — Read Before Downloading. Under Tex. Est. Code § 251.051, a valid Texas will must be in writing, signed by the testator in the presence of two credible witnesses who also sign in the testator's presence. The Texas UETA (Tex. Bus. & Com. Code § 322.003(b)(1)) expressly excludes wills from electronic signature validity. Every MaxWills document is a DRAFT. You must print it, sign it in wet ink before two disinterested witnesses age 14 or older, and have a notary acknowledge each party separately for a self-proving will. MaxSign is never used for will execution.

5. AI-Generated Content

MaxWills uses Anthropic Claude to generate document language. Statutory citations come from a verified Texas Estates Code map; AI generates surrounding language only. Your information is transmitted to Anthropic under their API Data Processing Agreement. We do not use your data to train AI models. Anthropic privacy terms: anthropic.com/legal/privacy. AI can make mistakes; review your documents carefully.

6. Digital Will Vault and Death Wall

The Digital Vault stores a scanned copy of your signed will and family instructions. Family invitees ("requestors") see only that a vault exists and how to contact the custodian — they cannot access contents until an authorized release.

Release requires human verification: A death certificate upload AND approval by the Owner or Managing Attorney is required. There is no automated release path. We will not release contents without attorney authorization.

No guarantee of original will: MaxWills stores digital copies only. We do not hold custody of your physical will. Instructions about the original's location are stored as family guidance; we cannot verify or guarantee the physical document's location.

7. Annual Subscription Auto-Renewal ($79/year)

The Digital Vault plan costs $79 per year and renews automatically. You authorize MaxWills to charge your payment method at the then-current rate each year. Cancel anytime in account settings. You will receive a renewal reminder at least 7 days before each renewal.

8. Texas Jurisdiction Only

MaxWills produces documents for Texas law only. For multi-state needs, consult attorneys licensed in each relevant state.

10. Fee Allocation & Dual-Entity Payment Disclosure

Two separate entities may be involved in your purchase. This section explains how payments are allocated.

Depending on what you purchase, your payment may be processed through one or both of the following entities:

No fee sharing occurs between Max AI and TDT. These fees never cross between entities. Each entity retains 100% of the fees it receives for its own services. This structure exists to preserve the independence of the legal services component and to comply with TDRPC 5.04 (prohibition on fee sharing between lawyers and non-lawyers).

Texas Sales Tax Notice: Texas may impose sales tax on certain data-processing and software services (Tex. Tax Code §§ 151.0035, 151.351). Attorney legal services are generally exempt from Texas sales tax. If Texas sales tax applies to Max AI's software/storage charges, it will be shown as a separate line item at checkout where Stripe Tax is configured. If you have questions about applicable taxes, consult a Texas CPA.

By completing a purchase involving attorney review, you acknowledge: (a) Max AI's software component and TDT's legal services component are separate; (b) your attorney fees go to TDT's trust account, not to Max AI; (c) TDT's scope of review is limited to the documents produced from your interview answers.

11. Attorney Physical Document Custody & Availability Retainer (Coming Soon)

This is an attorney service tier provided by Texas Defense Team, PLLC ("TDT") — not by Max AI, Inc. The $249/yr Custodial tier is distinct from the Max AI Digital Vault (software storage). It is a true availability retainer under Texas Ethics Opinion 611 for attorney-conducted physical document custody. This tier will be available soon; the full retainer agreement text is disclosed here in advance.

Attorney safekeeping duties: Attorney custody of original client documents carries safekeeping duties under Texas Disciplinary Rule of Professional Conduct 1.14. You may request return of your documents at any time at no charge.

Distinct from the Max AI Digital Vault: The Max AI Digital Vault ($99/yr, Max AI Stripe) stores encrypted digital copies of your scanned documents. The Custodial tier ($249/yr, TDT firm account) provides physical custody of your original executed documents by a licensed attorney. These are independent services; you may use one, both, or neither.

Affirmative acknowledgment of the full retainer agreement text will be required at signup, per the applicable Texas rules for written fee agreements (TDRPC 1.04).
