📄 1. Document Preparation Service

MaxWills is not a substitute for the advice of an attorney. MaxWills is a document preparation service. We help you create estate planning document drafts — including wills, durable powers of attorney, medical powers of attorney, and advance directives — based on your answers to an AI-guided interview. We do not provide legal advice, legal opinions, or legal representation of any kind. Generating a document through this service is not the same as receiving legal advice.

🤖 2. AI-Generated Documents

Documents generated through this service are produced by an artificial intelligence system guided by your answers and Texas statutory forms. AI systems can make mistakes. You should have any document reviewed by a licensed Texas attorney before signing or relying on it for any legal purpose. We make no warranty that AI-generated documents are correct, complete, or valid under Texas law.

⚖️ 3. No Attorney-Client Relationship

Using MaxWills does not create an attorney-client relationship between you and Max AI, Inc., or any of its employees or owners. Max AI, Inc. is not a law firm. No communication through this service constitutes legal advice or creates legal obligations on behalf of any attorney. The optional Attorney Review service — provided by a licensed Texas law firm through a separate written engagement — creates a limited-scope attorney-client relationship solely for the purpose of reviewing your documents. All other services provided by MaxWills remain document preparation only.

✍️ 4. Execution Requirements

A document draft is not a legally effective document. For estate planning documents to be valid in Texas, they must be properly executed in accordance with Texas law. Common requirements include:

Will: Signed before two competent, disinterested witnesses (Tex. Est. Code § 251.051).
Durable Power of Attorney: Signed before a notary public (Tex. Est. Code § 752.051).
Medical Power of Attorney: Signed before a notary public or two qualified witnesses (Tex. Health & Safety Code § 166.154).
Advance Directive: Signed before two witnesses or a notary public (Tex. Health & Safety Code § 166.032).

Generating a document through this service does not make it legally effective. You are responsible for having documents properly executed before relying on them.

🔍 5. Attorney Review

We recommend that you have any estate planning document reviewed by a licensed Texas attorney before signing. The optional Attorney Review service, available at checkout, connects you with a licensed Texas law firm for a limited-scope review of your completed documents.

The attorney review fee is paid directly to the law firm — it is not a Max AI software charge. This review creates a limited-scope attorney-client relationship with the law firm for the purpose of reviewing your estate planning documents only. The scope of that relationship is defined by the law firm's engagement, not by these terms.

🤠 6. Texas Disclosure

MaxWills is owned and operated by Max AI, Inc. This service was created by Stephen T. Bowling, a licensed Texas attorney (State Bar of Texas). Mr. Bowling's involvement in creating this service does not constitute legal representation of any user of the service. MaxWills is a document preparation service — not a law firm.

This service is designed for use by Texas residents. Estate planning laws vary significantly by state. Documents generated through this service are built around Texas statutes and may not be valid in other states. If you are not a Texas resident, consult a licensed attorney in your state before using estate planning documents generated through this service.

💳 7. Payment Terms and Refunds

Payment is collected at the completion of the interview, before your documents are generated. By paying, you authorize MaxWills to generate your estate planning documents using AI.

No refunds on generated documents. Once your documents are generated by AI, the service has been provided and no refund will be issued. AI generation incurs immediate computational cost that cannot be recovered.
Attorney review refund policy. If you purchase attorney review and the review has not yet begun, you may request a refund of the attorney review fee by emailing [email protected]. Once the reviewing attorney has begun reviewing your documents, no refund is available for the attorney review fee.
Payment processing. All payments are processed by Stripe. MaxWills does not store your payment card details.

✅ 8. Acceptable Use

MaxWills is designed for Texas residents who wish to create Texas estate planning documents. By using this service, you represent that:

You are a Texas resident or are creating documents intended to govern Texas property and assets.
You are at least 18 years of age and have the legal capacity to make a will under Texas law (Tex. Est. Code § 251.001).
You are using this service for your own genuine estate planning purposes — not to create fraudulent documents, test the system, or engage in any unlawful activity.
You understand that documents created through this service are intended for use in Texas under Texas law, and may not be valid in other states.

🔒 9. Limitation of Liability

MaxWills is not liable for errors, omissions, or legal insufficiency in AI-generated documents. You are responsible for having documents reviewed by a licensed attorney before signing.

To the maximum extent permitted by applicable law, Max AI, Inc., its employees, contractors, and owners are not liable for any damages arising from:

Errors, omissions, or inaccuracies in AI-generated documents.
Legal insufficiency of documents under Texas law or any other law.
Your reliance on documents without obtaining attorney review.
Failure of documents to accomplish your estate planning goals.
Disputes arising from improperly executed or legally insufficient documents.

If you have any doubt about the legal sufficiency of your documents, do not sign them without first consulting a licensed Texas estate planning attorney. This limitation of liability does not apply to gross negligence or intentional misconduct by Max AI, Inc.
